Policy Statement

Betway is committed to protecting and respecting your privacy and ensuring your security when you use our Services. This Privacy Policy is to help you understand what we do with your personal information and how we protect and process it.

This Policy governs the collection, use, disclosure, retention and other processing of personal information by Betway, including through Betway products and services, on Betway websites and via mobile applications.

Cadway Limited is operating the Betway brand Operator Website (herein referred to as Betway) and providing the Operator Offerings as part of the open and regulated internet gaming (iGaming) market in Ontario (iGO) conducted and managed by iGO and is collecting, using and disclosing Personal Information (PI) on behalf of, and as an agent to iGO.

Applicable Laws

We protect your personal information in accordance with all applicable laws, including Ontario’s Freedom of Information and Protection of Privacy Act (“FIPPA”), the Personal Information and Protection Electronic Documents Act (PIPEDA)(collectively the “Acts”).

This Betway Privacy Policy (hereafter, the “Policy”) is incorporated into and forms part of the betway.ca Player Agreement (the Player Agreement”). Any conflict of inconsistency between this Policy and the terms of the Player Agreement shall be resolved in accordance with Section 3 of the Player Agreement.

Regarding Children and Minors

Our website, applications and the services offered on our website and applications are not directed to individuals under the age of 19 (Minors). We will not knowingly collect personal information about individuals under the age of 19. We do not allow individuals under the age of 19 to create accounts, make purchases or enter contests or promotions.

Where a parent or guardian believes that a Minor has had their personal information collected and processed by Betway they can contact us via privacyexecutive@betway.ca to have the case reviewed and said Minor’s PI deleted.

Personal information we collect

Betway as an operator under authority from iGO is collecting, processing and disclosing personal information under FIPPA, Ontario Regulation 722/21 made under the Alcohol and Gaming Commission of Ontario Act, and the Operator Agreement with iGO. The collection, processing and disclosure of personal information is governed to FIPPA, PIPEDA and Ontario Regulation 722/21.

Under FIPPA, “personal information” means recorded information about an identifiable individual. In general, Betway collects the following types of personal information, although different types of information may be collected depending on the purpose of collection or if the collection is required by law:

Identity information (such as your full name, Driver’s Licence number or other official ID number, etc.);
Demographic information (such as your age or gender);
Contact information (such as your email address or phone number);
Location information (such as your address or the location of a device you use to access our website or applications);
Professional information (such as your occupation or industry of employment);
Banking or financial information (such as payment or withdrawal account information); and
Transaction information (such as play or payment history, customer service history, or other information related to transactions between you and Betway);

During the registration process and when you subsequently use your Betway account, you may be required to submit specific personal information including but not limited to:

your first and last name,
date of birth,
nationality,
place of birth,
occupation,
employer details,
payment data,
home or another physical address,
e-mail address,
phone/mobile number,
other contact data,
your unique username and password combination for your account.

Once you have created an account and have become a Betway customer, additional information is processed on an on-going basis.

Betway only processes data under the following lawful bases:

Consent – this is where we get your prior explicit agreement for processing.
Legal obligation – this is where we have to comply with a legal or regulatory obligation.
Legitimate Interest – this is where we balance the customer’s interests against the business’ interests.
Performance of a contract – this is where we process data to meet our contractual obligations to you.

Due to our legal obligations, we also collect information in order to verify your account, Betway may also collect:

a copy or scan of your passport or ID card;
a copy of a utility bill or bank statement;
a record of all internet communications and details of your visits to our Websites;
technical information relating to how you use our products, such as the type of device you are using and the browser you are using to access our Websites, this is where processing is necessary for the purposes of legitimate interest, in order to display and guarantee the stability and security of the Website;
payment information and details of transactions you carry out through the site, including your payment, withdrawals and wagers;
communications with us or our employees, for examples, calls, emails, and messages sent through the live chat service;
information regarding your location, including IP address and traffic information;
any additional information you submit through the website for example on forums, via your social profile, chat rooms, comment sections or in response to quizzes and questionnaires;
pages that you visited including what you have clicked on. Please see the Cookie Policy for more information;
Sometimes we may also request photo ID, proof of address, and source of funds;
Occasionally we may also access your public records (e.g.: news articles, social media, forums, official records such as the electoral roll).

In accordance with Section 9.5 of the Privacy and Access to Information Directive, we are committed to transparency regarding who within our organisation has access to your PI.

Betway engages with a range of third-party providers under contractual agreements. These providers may access PI only as necessary to deliver services and are subject to strict data protection obligations:

Access to your PI is strictly limited to personnel and service providers whose roles require it for support of our contract of service with you and those supporting our operational, regulatory and legal obligations.

The categories of personnel who may access PI include:

Customer Support Teams– for assisting with account-related inquiries and service issues.
Customer Service Teams – Handles customer queries and escalates to relevant departments (e.g., verification, responsible gaming).
Customer Welfare Team – Ensure we adhere to responsible gambling practices.
Technology and IT Operations – for maintaining system integrity, troubleshooting, and ensuring data security.
Marketing Team – for managing customer relationships and communications, where consent has been provided.
Compliance and Legal Teams– for ensuring regulatory and jurisdictional adherence, responding to lawful requests and advising on legal and policy matter.
Data Analytics and Product Teams – for development of features, service improvement and performance monitoring.
Privacy Team – Oversees data protection and privacy compliance across Betway.

Access to your PI is strictly controlled and monitored, and all personnel and service providers are subject to confidentiality obligations and regular privacy training.

To protect both you and us, we use Services provided by third parties to help us decide whether to accept transactions from you by assessing your method of payment, and the devices you use to visit our Websites. These third-party services check whether the device or method of payment has been identified with fraudulent or abusive transactions in the past, such as reported instances of identity theft, promotion abuse or credit card fraud.

Please be advised that we may not be able to continue to offer you gaming services if you provide us inaccurate or incomplete personal information. The processing of the requested personal information is necessary to ensure that Betway can meet its obligations.

If you visit our Website just to browse, and you are not a customer or choose not to register with us, we will only collect the personal information which your browser transfers to us and is technically necessary to display our Website and to guarantee its stability and security.

How we use your personal information

We use your personal information to try and provide you with the ultimate Betway experience whilst ensuring we meet regulatory requirements, legal obligations and business-related requirements. We process your personal information for the purposes of:

Creating your account and providing you with gambling services;

We use your personal information such as your name, DOB and email address to help set up your account and, if necessary, to contact you (according to your preferences) via your registered contact information in connection with the management and operation of your account.

We also use your personal information such as your device type, location and browser preferences to manage your account. We want to ensure that you can see the best version of Betway on your device and are authorised to use Betway in your current location. We do this based on our legal obligations and legitimate interests to provide you services.

Ensuring our Websites function correctly and identifying any technical issues;

As we want to give our customers the ultimate Betway experience, we may also use your personal information to help with internal research and development, internal testing of the products and to help diagnose system issues and make content and service improvements to the website.

Ensuring you gamble responsibly;

Betway is committed to ensuring that you gamble responsibly. So, to abide by legal obligations we will process your data to provide you with a safe environment to gamble, as well as to monitor you for potential at-risk behaviour.

We may share some of your personal information, including your first name, last name, DOB and address with a Credit Reference Agency so that we can carry out an affordability check on you, in certain circumstances. This check may leave a search footprint, but please note that this will not affect your credit score.

iGaming Ontario offers a voluntary centralized self-exclusion tool (“BetGuard”) whereby individuals may register to centrally self-exclude from all regulated igaming sites in Ontario . BetGuard is offered subject to the BetGuard privacy policy.

In connection with BetGuard, iGaming Ontario, (Operator), and their respective authorized suppliers on behalf of iGaming Ontario, may collect, use, share, disclose, retain, or otherwise process your Personal Information to develop, operate, maintain, sustain, update and modify BetGuard. This information may be used to verify your identity and centralized self-exclusion status, enable your centralized self‑exclusion from regulated igaming sites, or for any other lawful purpose under the BetGuard privacy policy and the BetGuard terms and conditions. Personal Information will be retained only for the period allowed by the BetGuard privacy policy and Applicable Law.

Identifying and verifying customers;

This includes the identification and verification of individuals under anti-money laundering legislation, ensuring customers are over 19 and to comply with responsible gambling rules and initiatives. To verify your age and the details that you registered your account with, we may disclose such information to approved third parties, such as with the Financial Transactions and Reports Analysis Center of Canada (FINTRAC) for the purposes of ascertaining identity under the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTA) and its supporting Regulations. Where we share your data with trusted third parties we ensure that appropriate safeguards are in place and that they will only use your personal information for the purpose they are instructed to.

Legal and regulatory obligations;

We are required to process and retain your personal information including but not limited to your name, account number, date and place of birth and location to prevent fraudulent activity, to detect and/or investigate crimes, and to ensure responsible gambling. Additionally, we may also process your personal information to meet our internal and external reporting requirements, such as information that is collected on behalf of iGaming Ontario, which iGaming Ontario may share with other Operators as part of enterprise level player monitoring.

Marketing;

Dependent on your marketing preferences, we will use your personal information to send you information by the contact methods you authorise us to use about our brands, products, competitions, prizes and offers for the purpose of marketing Betway's Services to you. The information We send to you about bonuses, promotions and marketing is based on your provision of consent.

You can choose not to receive marketing/promotional material at any time by managing your marketing preferences via ‘My Account’. We also provide you with the opportunity to opt out by reply in every marketing message we send after your initial consent to marketing.

If you have opted out of receiving marketing communications from us, we will take all reasonable steps to ensure you no longer receive promotional material about Betway. We may however still send you transactional emails, relating to the maintenance of, and changes to, your account.

Prevention of crime;

Betway has various policies and procedures designed to detect and prevent criminal activity. This includes fraud detection and our Anti-Money Laundering programme. We carry out this processing to comply with our legal obligations.

Processing your online financial and wagering transactions;

We need to use your personal information such as your account details, transactions, payment type(s), deposit method(s) and wager gaming history to allow you to deposit and withdraw, and for our regulatory reporting. This is to comply with our Terms and Conditions and legal obligations.

Profiling, automated decision making and your preferences;

We use your PI, such as your betting and gameplay records, behaviour, interests, location, age, online identifiers and analytics information to create new PI about you, that is derived from inferences and predictions that We make about you. We may use a combination of manual reviews and automated detection systems, supported by machine learning, to carry out this processing.

This information will be used for the following purposes:

To ensure our Services can be provided in your country location;
To ensure you gamble safely and responsibly;
To develop new features, functionality, products and services that are tailored to you;
To ensure the technical support you receive is tailored to the device that you use; and
To ensure the promotions you receive are tailored to your preferences

We carry out the processing listed above under points (a) to (b), to comply with our legal and regulatory obligations.

With regard to the processing listed under points (c) to (d), this is carried out to pursue our legitimate commercial interests, i.e. (i) We have a legitimate interest in ensuring We tailor our Services to reflect your specific needs and interests, so you receive the best customer experience and (ii) We have a legitimate interest in ensuring the technical support you receive is tailored to your specific needs.

We only carry out the processing listed above under point (e.) with your consent.

Betway may make automated decisions. We can confirm that no decisions will be made using solely automated processing that can have a significant or legal effect on you without being reviewed by a Betway employee.

Betway researches your preferences to develop new features, functionality, products and services.This profiling is in benefit to both you and us and ensures that we are using your personal information to meet our legal obligations in relation to: anti-money laundering; age verification; prevention of fraud; sports integrity and responsible gambling.

Risk management;

We review customer profile and betting data for the purposes of enforcing our terms and conditions, managing our financial liabilities, managing privacy risks and risks related to events and markets. For more information, please see the General Terms and Conditions. This is both to comply with our legitimate interest and legal obligations.

Who we share your personal information with

Certain trusted third-party companies provide services essential to our ability to offer our gambling products to you, for example those that supply the software and games for our Websites, banking, credit reference agencies, marketing services, payment services, identity verification via third-party software, fraud prevention and risk management. We may be required to share some of your information with these companies, some of which may be based outside Canada or the European Economic Area (EEA), to be able to offer our Services to you. In these instances, we ensure that the third party has appropriate security and privacy arrangements in place, so that your personal information is adequately protected.

Betway may also be required to disclose your information to government authorities, such as the police or our regulators, such as iGO, to comply with our legal obligations. Personal information may also be shared with regulators, agencies or relevant sports bodies where there are suspicions of involvement in match-fixing or breach of sports regulations. We will also disclose information as required to enforce our terms of use as stated in the Terms and Conditions.

In the event of the sale of our business, or other business event, which results in us having to transfer your personal information to a third party, you will be notified via email, or notice posted on our website, to explain the identity of the new data controller and your options regarding your personal information.

Our site may contain links to and from the Websites of third-party organisations. Please note that these Websites may have their own privacy policies and that we do not accept any responsibility whatsoever for these policies. Please check these policies carefully before you submit any personal information. We may send anonymised data to third parties in order to evaluate new technologies and improve service levels.

We collect information about you when you contact us through your account on any social media platform(s) such as Facebook, Twitter, etc. for various purposes (such as but not limited to entering a competition on the social media platform, contacting us for information via the social media platform).

We also collect information about you if you chose to interact with our content and pages available on a social media platform. When you do this, the provider of the social media platform may provide us with your details such as your account information. You should read the relevant social media platform’s privacy policy and terms and conditions to understand how and with whom you share your information when using their services.

How we store your personal information

Your personal information is stored within the European Economic Area (“EEA”). Where we work with third parties, the personal information we collect from you may be transferred to, and stored at, a destination outside the EEA or your country of residence. It may also be processed by staff operating outside the EEA or your country of residence who work for us or for one of our suppliers. Such staff may be engaged in, among other things, customer services, the processing of your payment details and risk/fraud management.

We ensure there are appropriate contractual controls over any data processor or third party that helps us process your personal information, to ensure that your rights are upheld and your personal information is secure.

We store your PI for as long as you are an active customer with us. Once you are no longer our customer, We will hold your PI in our systems for as long as is necessary to comply the data retention obligations in Ontario, such those imposed by tax, gambling and AML laws.

If you use a passkey (unique code or password) or biometric identification (such as fingerprint, face-scan or screen lock) to verify your identity on your device to access our products or services, this data is never shared with Betway. The passkey itself is stored on your local computer or mobile device, which will ask for your screen lock biometrics or PIN to confirm your identity. Biometric data is never shared with Betway or any of our third parties.

Keeping your personal information safe

We protect PI in accordance with Ontario and Canadian privacy laws, including FIPPA and O.Reg. 460 s.4(1). We have implemented appropriate technical and organisational security measures proportionate to the sensitivity of the data and designed to prevent loss, theft, and unauthorised access or disclosure, other than as authorised by you or as required by law.

Physical Access Controls - Betway enforces an Access Control Management Policy covering both systems and facilities.
Environmental Safeguards - Records are stored securely and protected from environmental risks such as natural disasters and accidental loss. Access is limited to those with a legitimate need, and documentation outlines the physical controls in place.
Technical and Operational Measures - We use encryption, pseudonymisation, firewalls, and access controls to secure PI. Data in transit is encrypted, and access is limited to those with a business need under confidentiality obligations.
Incident Management - We have procedures to detect, respond to, and report personal information breaches. Where required, we notify affected individuals, regulators, and iGO, and cooperate fully with investigations.
Supplier Assurance – Betway has in place a clear onboarding process for suppliers that enforces our expected organisational and security controls aligned to international standards such as ISO/EEC27001.

However, despite our safeguards and efforts to secure your personal information, please remember that data transmitted via the internet is by virtue not always 100% secure. We endeavour to always apply the most appropriate security measures to counteract this. We will always deploy security measures, such as end to end encryption to protect the transmission of your personal information when you use our Website, but you should also only access the Website within a secure environment.

In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to access same. They will only process your personal information on our instructions, and they are subject to a duty of confidentiality.

Managing security incidents relating to personal information:

As an operator licenced to iGO we have an endorsed process in place for the handling of any information security incident, any cybersecurity breach and any personal information breach that may occur. When identified, any such breaches are remediated in accordance with the requirements placed upon us by iGO and according to the relevant internal policies and procedures. iGO will be notified of any data breaches/incidents in line with our reporting responsibilities. Betway are committed to mitigating any other privacy risk that may be identified. We have robust security controls in place and regularly review security controls to mitigate and minimise any potential risks to your personal information.

If you have any reason to believe that your Player Account information may no longer be safe, please contact our customer support staff without delay.

Keeping your Customer Account safe:

When you create a Player Account with us, we ask you to choose a password. We use password protection to ensure your Player Account remains safe and secure at all times and can only be accessed by you.

We highly recommend that you choose a password that is strong and not easy to guess, and it is good practice to change your password regularly and to not use the same password that you use with other sites. You should never share your username and password details with anyone. If you suspect your password has been disclosed to anyone or compromised in any way, please reset it immediately to ensure your Player Account remains safe and secure.

How long we store your personal information

We retain personal information in line with our Retention and Disposition Policy and Schedule as dictated by any applicable laws and the iGO Operating Agreement. We will take all necessary steps to ensure that the security of your personal information is maintained for the period of retention.

Your Rights

You are a data subject, your personal data belongs to you, so you have rights over your personal data. Some of these rights only apply in certain circumstances.

Under the FIPPA, you have

The right of Accuracy – please contact Us via the help page or via live chat to update or correct your PI. You can help make sure your data is accurate by letting us know of any contact detail changes, any relevant changes to your circumstances or your occupation.

Under FIPPA, you have the right of Access and Accuracy. Under PIPEDA, you have the right to withdraw any consent you have provided for the collection, disclosure, or use of your personal information (although, if you do so, we may no longer be able to provide services to you). Since your personal information is being processed in the EU, you also have supplementary rights under GDPR which you can find out more about here.

We advise all of our customers to keep their personal information in connection with our operator website and offerings protected. We recommend that they take action such as using strong passwords that have a combination of upper and lowercase letters, numbers and symbols and do not share their passwords or log in details with anyone.

If you are unsatisfied with the outcome of your query or concern, then you have the right to complain to iGO, for which you will need a casefile number that will be provided to you by Us.

If you have any concerns or queries about your personal information rights, don’t forget that you always have the right to complain to a data protection regulator. We are regulated by the Information and Privacy Commissioner of Ontario (IPC) and Office of the Data Protection Authority (ODPA) of the Bailiwick of Guernsey.

Changes to this policy

We reserve the right to change this Privacy Policy at any time, so please re-visit this page frequently. We will provide notice of substantial changes of this Privacy Policy and will send you a notice or an e-mail regarding such changes. Otherwise, all other changes to this Privacy Policy are effective as of the stated “Last updated” date, and your continued use of the Services after the Last Revised date will constitute acceptance of, and agreement to be bound by, those changes.
